That guy in the video doesn't know what he's talking about. It's not just videos of Nintendo games that are getting flagged, it's video games made by literally every company in existence and those companies have nothing to do with the copyright claims. It's all the fault of YouTube's new automated copyright ID system. It's even flagged videos of independent games posted by their actual creators claiming that they don't own the content that they created from scratch.

For further context, the developers of Braid and VVVVVV had their own videos of the games flagged
