Yeah as far as I know this has been a thing since 9.b the hitbox for activating Death (the reaper) is completely different so the normal hitbox can sometimes whiff while also activating Death. In your example you already swung too early but since the hitbox for Death's activation still lasts for as long as the scythe is out you still got it to connect
