It might be possible that they haven't received a C&D directly so much as fearing one.

Like Kyuubit said, in a few months they are probably going to kickstart/beg for money for their Not Smash Bros. project 'Project Wavedash (trademark)' and they likely found that out that after Project M any further Not Smash Bros they'd make could be considered illegal derative work of Melee so they tried to cancel Project M as hard as they could.
