The bat looks jaggy and edited, the head looks like an edited version of the SSBB portrait, the picture-taker has an image editing program open...

If it was an actual leak the leaker wouldn't cover up the url. Besides its not really a big leak if its real because we all know Ness is gonna be in Smash Bros.

If it was a leak, there would be a way to access it via URL

using the format from the smashbros page, it would be
http://www.smashbros.com/jp/characters/ness.html

...which, unsurprisingly, throws a 404 error and has nothing.
