Isn't it still ambiguous in the cartoon? The camera pans down as soon as Batman puts his hands on Jokers shoulder, and then Joker's laughing ceases while Batman's continues.

The comic has silhouettes instead, it looks like batman choking the joker, just as much as it looks like he put his hands on his shoulder. Just read the graphic novel, it's quite short. They added in a dumb scene in the movie about batman talking to prostitutes which was supposed to continue the joker rape theory, which is s***. Rape isn't part of his M.O
